General conditions and internal regulations

Definitions

​​

  • Owner: Natural or legal person who owns the property made available to the customer.

  • Customer: Individual who books the accommodation

  • Accommodation : The gîte made available to the customer, known as "The Lodge".

         1. Purpose of the contract

​

These general conditions govern the contractual relationship between the owner of the accommodation and the customer, to the exclusion of all other conditions. They may not be departed from without the express written agreement of the owner.

Any reservation made by the customer implies knowledge and express acceptance of these general conditions and any internal regulations.

2. Booking

​

The contract is formed as soon as the reservation is definitive.
The reservation becomes definitive once it has been accepted by the owner and the deposit has been paid in accordance with the terms and conditions set out in article 3.4 hereof.
From that moment, the customer may no longer exercise the right of withdrawal as referred to in article VI.47 of the Code of Economic Law or modify the reservation, without prejudice to the right of cancellation referred to in article 3.5 hereof.

Upon acceptance of the booking by the Owner, the latter will send the Customer by e-mail a document containing :

  • A summary of the booking (details of the customer, composition of the group, dates of stay, address of the accommodation, etc.)

  • The total cost of the holiday as referred to in article 3.4 and the terms of payment

  • The amount of the deposit and the terms of payment

  • The contact details of the host on the day of arrival

3. Prices

​

3.1 The prices shown on the accommodation website are indicative and may vary depending on the package booked.


3.2 The contractual price is fixed at the time of booking and includes :

  • Rental of the furnished and equipped accommodation

  • Utilities (heating oil, electricity, water)

  • Bed linen

  • Cleaning service

  • Access to leisure facilities

  • Wi-Fi

  • Baby equipment (cot, bath, changing mat, playpen, high chair)

  • Barbecue equipment

3.3 This price does not include :

  • Electric car battery recharging

  • Bath sheets (7€ per person for the stay)

  • Tourist tax (1€ per person/day (to be paid on site))

3.4 The total price of the holiday, consisting of the booking price referred to in article 3.2 and the supplements referred to in article           3.3, is payable into account number BE28 0689 4572 9920 (BIC code: GKCCBEBB) in accordance with the following terms and  c         conditions:

  • 50% deposit payable at the time of booking, within 5 days of acceptance by the owner

  • Balance payable 10 days before the date of arrival

  • Before the start of the holiday and after payment of the total price of the holiday, the Owner will send the Customer a holiday voucher by e-mail, which must be presented to the Owner or the receptionist on the day of arrivaI. In case of a late booking (less than 10 days before the arrival date), the total amount of the stay and the deposit referred to in article 3.6 must be paid at the time of booking. The customer must send a copy of the proof of payment no later than two days before the date of arrival. Failing this, the owner reserves the right to refuse access to the accommodation and to terminate the contract to the detriment of the customer in accordance with article 7 hereof.

3.5 Cancellation :

      In case of cancellation of the booking by the customer after payment of the deposit referred to in article 3.3, the owner will                  receive, by way of compensation, an amount equal to :

  • If the cancellation is made more than 40 days before the date of arrival: 30% of the total price of the holiday as referred to in article 3.4.

  • If the cancellation is made between the 40th day and the 21st day before the arrival date: 50% of the total price of the holiday as specified in article 3.4.

  • If the cancellation is made between the 20th day and the 8th day before the arrival date: 80% of the total price of the holiday as specified in article 3.4.

  • If the cancellation occurs between the 7th day and the arrival date: 100% of the total price of the stay.

3.6 Deposit :
      A deposit of €400 must be paid to the owner on site.
      This deposit will be returned to the customer's account within two weeks of the end of the stay, after deduction of any costs                incurred for repairing damage to the accommodation or for cleaning outside the normal use of the rented premises.
      If the amount of damage exceeds the amount of the deposit, the customer undertakes to pay the excess amount.

4. Arrival - Departure - Use of premises

​

4.1 The customer must arrive at the accommodation between 5 p.m. and 6 p.m. on the day of arrival to collect the keys. If they are          unable to arrive during this time, they must inform the owner the day before their arrival date so that we can agree an arrival            time.
      Departure must be before 10 a.m. (if renting for 2 nights at the weekend, then departure must be on Sunday until 8 p.m.) after            the keys have been returned.
      The customer must return the accommodation in a clean and tidy condition.

4.2 The customer undertakes to be present in the accommodation throughout the stay and to enjoy the accommodation peacefully,           in accordance with the use for which it is intended, and as a good father of the family.
      All equipment and facilities in the accommodation will be used in accordance with their intended purpose.
      The customer also undertakes not to park vehicles in places not intended for this purpose and not to install temporary                        accommodation (tents, mobile homes, etc.).
      The customer will be personally liable for any damage, loss or deterioration to the accommodation, its equipment and facilities,         to third parties and/or their property, whether caused by him personally or by persons staying with him.

4.3 The accommodation has a maximum capacity of 9 people (adults, children and babies combined). The customer undertakes to           respect this maximum capacity.
      They also undertake not to organise any student parties, stag or hen parties or any other activities not authorised by the owner.


4.4 Animals are not permitted in the accommodation or on the entire property.


4.5 Smoking is not permitted in the accommodation.


4.6 If the Client fails to comply with the obligations set out in Articles 4.2 to 4.5, the Owner reserves the right to terminate the                    contract in accordance with Article 7 hereof.

5. Insurance

​

The customer undertakes to take out insurance covering his liability in the event of damage to the accommodation, its equipment or installations.

​

6. Wellness area

​

The wellness area is forbidden to people who are drunk or suffering from contagious diseases.
The wellness area is accessible to children ONLY in the presence of their parents. Do not leave your children unsupervised at any time.
The owner declines all responsibility for accidents caused by users of the wellness area.

7. Cancellation

​

The owner has the right to terminate the contract without compensation or notice in the following cases:

  • If the customer fails to comply with the payment terms set out in article 3.4.

  • If, during the stay, the customer does not comply with these general terms and conditions, and in particular articles 4.2 to 4.5.

In such cases, the customer will be liable to pay compensation for the loss suffered, set at a flat rate as follows:

  • If cancellation takes place more than 40 days before the arrival date: 30% of the total price of the stay as referred to in article 3.4.

  • If cancellation takes place between the 40th day and the 21st day before the arrival date: 50% of the total price of the stay as specified in article 3.4.

  • If cancellation takes place between the 20th day and the 3rd day before the arrival date: 70% of the total price of the stay as specified in article 3.4.

  • If cancellation is made on or after the 2nd day before the arrival date: 100% of the total price of the stay.

8. Claims

​

Any complaint regarding the accommodation must be made to the owner or his representative within 12 hours of arrival and confirmed in writing.

9. Others

​

  • The customer shall provide the owner with correct and complete information, in particular concerning the composition of the group and the reason for the stay, when making the reservation and undertakes to inform the owner immediately of any changes that may occur before the start date of the stay or during the stay.

  • The customer may not transfer this contract without the express written agreement of the owner, no later than 15 days before the start of the holiday.

       In the event of a transfer duly authorised by the owner, the transferring customer and the transferee customer are jointly and             severally liable to comply with these provisions, particularly with regard to payment of the total price of the holiday.
